Criminal Judicial Assistance

(english.legalinfo.gov.cn) Updated : 2015-06-04

In judicial assistance treaties with foreign countries, the scope of criminal activity is limited to serving writs and providing evidence. More specifically, upon request, the treaty signatory will serve the other party's documents and take a statement from litigants or criminal suspects, contact witnesses or victims, identify or investigate, and collect other evidence. Some treaties deal with information on the results of criminal action or the transfer of stolen money or goods. But, the main way criminal judicial assistance as covered by China’s treaties operates is in the serving of documents and the investigation and collecting evidence. China has criminal judicial assistance agreements with 13 countries: France, Bulgaria, Estonia, Thailand, South Korea, Indonesia, the Philippines, Canada, Colombia, the US, Tunis, South Africa and Brazil.
